Is my business name the same as my trademark? What about my website’s domain name?

Your business name is not necessarily your trademark and does not automatically enjoy trademark protection, even if you registered it with your state’s secretary of commerce. In fact, many business names are not used publicly or prominently. Similarly, registering a domain name does not automatically confer any trademark rights or protection. Your selected name must be used as a brand with consumers in order to gain trademark protection.
